Terms of Use

GuidedGrowth Coach is a coaching and planning tool for invited real estate agents; it does not replace your brokerage's records or professional advice.

1. Who provides the app

The app is provided by Roy Houshmand, operating as GuidedGrowth, in Ontario, Canada. In these terms, "we" and "us" mean GuidedGrowth, and "you" means the agent using the app.

2. Who may use it

The app is for real estate agents invited by the coach. You must be at least 18 years old and registered to trade in real estate in Ontario, or working toward that registration as part of your coaching. You accept these terms, the Privacy Policy, and the GuidedGrowth Participant Agreement when you first log in. Your coaching services, fees, and commitments are set out separately in your GuidedGrowth Coaching Services Agreement.

3. Your account

1. Keep your password private and do not share your account.
2. Log out when you finish, especially on a shared computer. The app also logs you out after 60 minutes of no activity.
3. Tell us right away at royhoushmand@gmail.com if you believe someone else has used your account.

4. Your responsibilities

When you use the app, you agree to:

1. Enter accurate information about your activities, deals, and income.
2. Record client information only for a real estate purpose, with the consent the law requires.
3. Send commercial electronic messages only in line with CASL.
4. Follow TRESA, RECO's rules, including its advertising rules, and your brokerage's policies. For example, Just Sold marketing should wait until a sale has closed, and any sale price should be advertised only with the seller's consent.
5. Not use the app for anything unlawful, and not try to access another person's account or information.

5. Not professional advice

The app's income goals, commission figures, HST amounts, and activity recommendations are planning estimates. They are not legal, accounting, tax, or financial advice. Confirm actual figures with your brokerage and your own advisors.

6. Not your official records

The app is not a brokerage record keeping system. Your official transaction records must be kept through your brokerage and its transaction software, such as SkySlope, as TRESA requires.

7. Availability and changes to the app

We work to keep the app available and accurate, but we cannot promise it will always be available or free of errors. We may add, change, or remove features as the coaching program develops.

8. Ownership

The app, its design, and the GuidedGrowth coaching content belong to GuidedGrowth. The information you enter remains yours, and you may ask for a copy of it at any time.

9. Ending your use

You may stop using the app at any time by asking the coach to close your account. We may suspend or close an account that breaks these terms or when your coaching ends. When an account is closed, its information is deleted as described in the Privacy Policy.

10. Limit of liability

To the extent the law allows, GuidedGrowth is not responsible for lost income, lost business, or decisions made using the app's estimates. Our total responsibility for any claim related to the app is limited to the coaching fees you paid GuidedGrowth in the 12 months before the claim. Use of the app is included in your coaching and has no separate fee.

11. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.

12. Changes to these terms

If we change these terms, we will update the date at the top and notify you in the app or by email. Continuing to use the app after a change means you accept the updated terms.
